
New Delhi . The Delhi High Court has said that sexual assault on a child reflects the corrupt mentality of the offender and that the crime is not of a private nature as it has a serious impact on society. The court made this remark while refusing to quash the FIR lodged against the man who raped a seven-year-old child.
The High Court stated that the Protection of Children / Children from Sexual Offenses (Poxo) Act was brought because the current law did not have adequate treatment for sexual misconduct against children and aimed at protecting children from sexual assault and harassment. It said that such a crime would be compromised and the revocation of the primary would harm justice and said the charge against the accused was “serious”. The court also said that the victim’s father cannot be allowed to compromise the accused in the dispute as he is not a victim and the courts have to protect the children against the evil forces. According to the prosecution, in November 2019, the child’s father filed an FIR alleging that he found his son crying when he returned from work. The child told his father that after going to work in the afternoon, the accused living in the same house came to his room and raped him.
