The Joint Parliamentary Committee (JPC) reviewing the Constitution (130th Amendment) Bill has proposed significant changes regarding public office holders facing judicial custody. The committee recommends that if the Prime Minister, Chief Minister, or any minister remains in judicial custody for more than 30 days, they should be suspended from office temporarily rather than removed permanently. If the individual is later acquitted, released, or the prosecution fails to proceed within the prescribed period, they should be allowed to resume their position. The committee also suggested safeguards to prevent misuse of the law, define serious offences clearly, and include a sunset clause for periodic review.
